Bush Names Harriet Miers to Supreme Court
I'm a bit on the fence for Bush's latest pick for the Supreme Court. There's enough cause to be skeptical of her nomination, yet anything that makes the Power Line gang "disappointed" doesn't strike me as altogether bad.
Still, I've got to wonder if the Rove/Bush machine have truly lost their last remaining connection to the political radar that has, up till Katrina, served them fairly well.
I mean, when you're being dogged for cronyism, is it really smart to name someone who's only qualification for the office is her personal relationship with the President?
It's worth noting that I'll not bother dogpiling on those who would suggest that Miers is unqualified by some measure of her lacking judicial experience. I happen to think there's something rather noble about the idea of a citizen judge (although Miers at least has a law degree). Judge Roberts was just named Chief Justice, not on the basis of his brief judicial career, but moreso on the basis of his more stellar legal career. So I'd just as soon see that line of argument put out to pasture.

My bigger concern is her lack of appellate experience. While some people may think "a lawyer is a lawyer", there is a pretty big difference in the thinking of a trial attorney from an appellate attorney.
More so, CJ Roberts displayed brilliance as an appellate lawyer.
As a practicing appellate attorney, let me emphasize Mr. Warren's above statement. Also, I'd add that Ms. Miers was a corporate attorney, not a trial lawyer. I wonder how often she has been in court in the last 25 years? (honestly wondering, not being snarky -- I've been practicing for 3 years and have set foot in court once).
Please ignore my comment on Ms. Miers' non-trial practice. I had read that she was a corporate attorney, but that was obviously error, and she was a trial attorney for some time. Mea culpa.
